Bulgaria Right-Wingers Accuse Prosecutors of Vested Interests

Ivan Kostov, leader of Bulgaria's die-hard rightists and former prime minister, has accused the prosecutor's office of serving the interests of the ruling coalition.

"The annual report of the prosecutor's office does not even mention any of the plot murders, nor the four cases against Interior Minister Rumen Petkov, which have been suspended for no clear reason," Kostov, head of the Democrats for Strong Bulgaria, said during the debates of the report.

According to him the report is drowned in statistical data and gives no indication of the expected turnabout in the work of the prosecutor's office.

Interestingly, the ruling Socialists' most outspoken member Tatyana Doncheva stood by the opinion of Ivan Kostov, saying such statements were not without grounds.

Doncheva pointed out as an example the case against former fire-brigade head Gen. Kiril Voynov, who was accused of malfeasance in office over the alleged misuse of office mobile phones.

"Prosecutors should find the golden section between PR events and reality, even though I know for sure there are ministers who take reality for a PR event," she added.

Miglena Tacheva: Prosecutors should work in a country where the force of law, not the law of force prevails

Sofia. It is too ambitious to stand and make evaluation for the activity of the judiciary, the Bulgarian Minister of Justice Miglena Tacheva said speaking to MPs in plenary hall. Tacheva made this comment at the end of the discussion of the report on the activity on the Prosecutor’s Office in 2006,a reporter of FOCUS News Agency informed.
Tacheva greeted the Prosecutor in Chief and the judges as a whole for the report, because ‘this is the first step towards the promised transparency and dialog in the activity of the judiciary’, she said.
‘I wish the Prosecutor in Chief and the rest of the Prosecutors to work together in a way to establish the state of law, where the force of the law prevails over the law of force’, Tacheva said.

Mincho Hristov: Sometimes MP are organized criminal group

Sofia. There should be changes in the Penal Code or a new one should be passed, Borislav Balgarinov, member of Bulgarian People’s Union (BPU), declared, reported FOCUS News Agency. The present Penal Code was 40-year-old and couldn’t possibly respond to the new social relations. Balgarinov expressed his gratefulness towards those who voted for the amendments in the Constitution which gave way for a debate on the condition of the prosecution. According to him there are some weak points in the judicial preparation of the court investigators – some of them are new. “The quality of the work on the pre-court proceedings is low”, Balgarinov says and adds that there should be changes in the ways of thinking in the prosecution.
According to the independent MP Mincho Hristov a change in the ways of thinking in the judicial power is not that urgent on the background of other problems in it. He added that the basic problem is the one with corruption. In order for it to be solved Hristov thinks that the immunity of the MPs should be abolished. In second place, the collective decisions should not be free of penal responsibility. According to him this would mean an organized criminal group.
The deputy-chairman of the Parliament, Lyuben Kornezov announced that Hristov is insulting the Parliament with such definitions. Hristov responded by saying that 240 MP-s sometimes represent an “organized criminal group” because they introduce lobbyist interests in the legislation. Mincho Hristov considers that it is important for a revision to be made on all privatization deals as well as on the so called “credit millionaires”.
Hristov’s phrase “organized criminal group” will be entered for consideration in the Parliament Committee of Ethics.

Ivan Kostov: The report of the Legal issues commission is written with pink glasses

Sofia. According to the leader of the Bulgarian political party Democrats for Strong Bulgaria Ivan Kostov, the report of the Commission for legal issues in the Parliament is written with pink glasses. ‘I am starting to think that me and the Chairman of the Commission have read two different reports. The activity of the Prosecutor’s office does not need a pink reading, the leader of DSB said.
Kostov was speaking during the discussions of the activity of the Prosecutor’s office for 2006, a reporter of FOCUS News Agency informed.
According to Kostov, the accent should be put on the fact that Bulgaria has gone through very serious criticism in for the pre-court phase of the investigations.

Maya Manolova: The Supreme Administrative Court and the Supreme Court of Cassation should present reports to Parliament as well

Sofia. The report of the prosecution is the first thing which the bodies of the judicial power introduced after the amendments in the Constitutions, Maya Manolova, member of leftist “Coalition for Bulgaria”, declared, cited by FOCUS News Agency. Manolova pointed out that the Supreme Administrative Court and the Supreme Court of Cassation should present such reports as well.
Concerning the report of the Prosecution for 2006 Maya Manolova declared that she had expected difficulties in its preparation but this has not been the case. It rather created difficulties for the MPs with the amount of the contents of about 250 pages. “This is a full, objective, specific and a comprehensive report,” announced Maya Manolova. According to her the data for lapses in the separate sections in the prosecution were not omitted. She underlined that the responsibility of the separate sections of the juridical system was not hidden, even more it is measured in specific data. In her opinion this is what lacked in the prosecution and thus transparency will be created in the juridical system. “The prosecution is the first section which entered the juridical inspectorate,” the deputy reminded. She doesn’t agree that it is normal for the number of the legal proceedings of the prosecutors to be small.

Many facts in Sofia Heating Utility case will be uncovered: prosecutor

Sofia. Many of the facts in the Sofia Heating Utility case will be uncovered, Bozhidar Dzhambazov, supervising prosecutor in the case, said in an interview with the Bulgarian bTV television channel.
In his words the facts are very surprising and date back to 1996-2006 – the period when the company was managed by Valentin Dimitrov. The damages caused in the period amount to millions, the prosecutor stressed.
So far there is no new defendants, he added, emphasizing it was difficult to say how many cases related to the Sofia Heating Utility one would be initiated. Dzhambazov reminded they started with three and now there are seven cases.

SCHOOL STUDENTS TO HELP FIGHT CYBER CRIMES IN BULGARIA

Students from the John Atanassov High School in Sofia would be helping the Interior Ministry (IM) in its fight against cyber crime in Bulgaria, ministry officials said on October 22, as quoted by mediapool.bg.

The initiative was in line with Interior Minister Roumen Petkov’s desire to enlarge the network of non-payroll agents. The school students however, would not act under cover but would contribute by proposing ideas and investigating suspected crimes online. They would also be involved with IM’s new web site cybercrime.bg, which was officially launched on October 22, mediapool.bg said.

The site had been developed by pupils of the high school, supported by the head of the computer crimes’ division of IM’s Chief Directorate for Combating Organised Crime (CDCOC), Yavor Kolev. Kolev was notorious among Internet users in Bulgaria for his actions against file sharing and torrent trackers.

The idea of the new initiative was to have a number of “Internet patrols” among school students reporting to CDCOC on sites having illegal content or other violations. In addition, Kolev said that one of the goals was to keep children informed of the dangers that Internet use could carry.

Students said they wanted to help prevent sexual abuse of children and act against paedophiles on the net. The Internet patrols were also expected to report financial cyber crimes.

Three-day workshop in law training to be held at National Justice Institute

Sofia. The National Institute of Justice will hold a three-day international conference themed ‘Mutual trust and judicial training. Towards a common culture in European law training’, the institute informed. The conference starts on October 24 at 9.30 am in Hall 201 of the institute. The event is held within a twinning project of the institute and the law school in Barcelona. Magistrates and experts on European law from EU member states will attend the event. Judges and prosecutors specialized in European law will take part, too. Michael Humphreys, Head of the Representation of the European Commission to Bulgaria will attend the opening.

Bulgaria: Vandal attempts against the rolling stock of the BDZ EAD continue

Yesterday, about 09:30 a.m., one of the newly delivered from Germany passenger coach of the Bulgarian State Railways EAD has been thrown stones at by unknown persons.

The incident happened on its way to the National Research Institute on Transport where it had to be certified for technical fitness necessary for its operation within the rail transport system.

As a result of the vandal attempt the windscreen of the coach was broken. Similar ill - intended acts agains the rolling stock are registered every day. Even the newest rolling stock is exposed to such vandalism.

The new Desiro DMUs are constantly thrown stones at. Yesterday, the newly delivered passenger coach was attacted even before its putting into operation.

Such vandalism additionally complicates the financial state of the entity and hinders all its efforts to achieve better and higher quality of servicing of the population. It also brings to the table the question of safeguarding of the rolling stock whose owner is the railway operator, the Bulgarian State Railways EAD. The yesterday’s incident is a motive for the Bulgarian State Railways EAD to address the responsible state institutions in order to contribute to the resolution of this problem. The opinion of the entity is that it could happen only with the full support of the State whereas the safeguard functions shall be taken by the Transport Police which are financed by the state budget.

The railway operator appeals to the State for support and for undertaking of measures for prevention of vandalism which the railways suffer every day.

Hackers’ attack (ROUNDUP)

Sofia. The Internet site of the Bulgarian Ministry of Agriculture and Food Supply was hacked by Turkish hackers on early Saturday.
When opening the site you can see the name of the organization that some time ago hacked the site of Attack party – “Ayyildiz Team”, the landscape with Turkish symbols, and a message in English and Turkish, saying the hacker’s attack is a protest against Volen Siderov and his Attack party.
Earlier today BNR announced, quoting BG Turk, the Internet site of the Ministry of Regional Development and Public Works was also hacked. However, the site is accessible and no signs of a hacker’s attack are visible.

An insider from the Ministry of Agriculture might have helped with the attack against the ministry’s Internet site because it is headed by a Turk, Attack party leader Volen Siderov announced later. He was commenting the hacker’s attack against the Internet site of the Bulgarian Ministry of Agriculture.
He added he did not expect for the Bulgarian services to act adequately.

Turkish hackers attacked the Internet sites of two Bulgarian state institutions – Ministry of Agriculture and National Directorate for Building Control, Focus News Agency noticed.
The message says: “Because the Attack party and Volen Siderov tell lies, the internet sites of some of your state institutions have been hacked by Ayyildiz group. The more lies are told, the more attacks will be carried out.”
A video footage from www.youtube.com can also be seen on the site. The material shows a plaque in the village of Tranak, Burgas region, being broken. Two masked youths are breaking with picks the plaque put in memory of three Turks shot as terrorists in Bulgaria in the period 1984 to 1986.

The website of the Bulgarian Ministry of Agriculture and Food Supply has been hacked on Saturday between 11.00 am and 12 noon. Agriculture Minister Nihat Kabil has immediately notified the Chief Directorate for Combating Organized Crime (CDCOC). Specialists and officials from the directorate are currently working on recovering the webpage.
The database of the site of the ministry has not been affected at all.
